RELATIONSHIP WITH GAMEONINDIA
- Volano Entertainment Private Limited ("GameOnIndia") provides, after registration on its website www.gameonIndia.net ("Website"), sports event management facilities for various sports to working professionals so that such professionals may partake in sports of their preferred choice ("Services"). You or the User by registering on the Website for availing the Services, agrees to abide by the GameOnIndia Privacy Policy and these Terms of Use. These Terms of Use will remain in full force and effect while the User uses the Services.
- The GameOnIndia Privacy Policy together with the Terms of Use forms a legally binding agreement between GameOnIndia and the User in relation to the Services. You must read the Terms of Use and the Privacy Policy carefully. These Terms of Use are referred to below as the "Terms".
ACCEPTANCE OF TERMS
- By clicking on "I ACCEPT" or "I AGREE", the User agrees to these Terms.
- The User will not avail the Services and must not accept the Terms if the User is not of legal age to form a binding contract with GameOnIndia.
PROVISION OF SERVICES BY GAMEONINDIA
- The Services will be available to the User subsequent to the registration by the User and subject to payment of fees by the User. The fee paid for the Services is non-refundable.
- GameOnIndia also has the right to suspend any Services or components thereof, permanently or temporarily, at its sole discretion. However, GameOnIndia will not be held liable for consequences arising out of such suspension of Services.
PASSWORDS AND ACCOUNT SECURITY
- The User agrees and understands that the User is responsible for maintaining the confidentiality of passwords associated with its account which is created on the Website after registration of the User.
PRIVACY AND PERSONAL INFORMATION
- For information about GameOnIndia’s data protection practices, please read GameOnIndia’s privacy policy at [insert URL]. This policy explains how GameOnIndia treats Personal Information, Sensitive Personal Information and protects the privacy of the Users. The User
  agrees to the use of data in accordance with GameOnIndia’s privacy policies.
CONTENT IN THE SERVICES
- The User agrees and acknowledges that all information (such as written text, logos, illustrations, pictures, videos, etc.) which the User may have access to on or through the Website is sole property of GameOnIndia. Certain information on the Website or otherwise, including but not limited to advertisements and sponsored content may be protected by intellectual property rights that are owned by the sponsors or advertisers who provide that content to GameOnIndia.
PROPRIETARY RIGHTS
- The User acknowledges and agrees that GameOnIndia owns all legal right, title and interest in and in relation to the content published on the Website. Unless the User has agreed otherwise in writing with GameOnIndia, nothing in the Terms gives the User a right to use any of GameOnIndia’s trade names, trademarks, service marks, logos, domain names, and other distinctive brand features (whether registered or not) in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.
- The User will not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to GameOnIndia (whether registered or not) without obtaining the prior written consent of GameOnIndia. GameOnIndia will take strict legal action against any User who infringes the intellectual property rights of GameOnIndia.
ENDING THE RELATIONSHIP WITH GAMEONINDIA
- The User may terminate the legal relationship with GameOnIndia by notifying GameOnIndia at any time and closing the accounts for all Services availed by the User or by not renewing the Services offered by GameOnIndia. These Terms will continue to operate until the User stops availing services from GameOnIndia. However, provisions in these Terms related to protection of and restriction on the use of intellectual property owned by GameOnIndia will continue beyond the termination of relationship between the User and GameOnIndia.
- GameOnIndia may at any time, terminate the legal relationship with the User if the User has breached any provision of these Terms (or has acted in manner which clearly shows that the User did not intend to, or is unable to comply with the provisions of the Terms) or has not paid the required fee for availing the Services.
EXCLUSION OF WARRANTIES
- Nothing in these Terms will exclude or limit GameOnIndia’s warranty or liability for losses which may not be lawfully excluded or limited by applicable laws of India.
- The User expressly understands and agrees that the usage of the Services is at the sole risk of the User. The User represents that the information provided by the User is true, accurate, current, and complete.
- In particular, GameOnIndia or its affiliates do not represent or warrant to the User that:
  1. the quality of the Services will meet the precise requirements of the User; and
  2. the provision of Services will be uninterrupted or timely.
LIMITATION OF LIABILITY
- any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by the User, however caused and under any theory of liability;
- any loss or damage which may be incurred by the User, including but not limited to loss or damage as a result of:
  1. any reliance placed by the user on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between the user and any advertiser or sponsor whose advertising appears on the website;
  2. any changes which GameOnIndia may make to the Services (or any features within the Services);
  3. failure on part of the User to provide GameOnIndia with accurate account information; and
  4. the failure of the User to keep password or account details secure and confidential.
- ADVERTISEMENTS
  - Some of the content on the Website may include advertisements and promotions by GameOnIndia associated entities. However, GameOnIndia will not liable under any circumstances for any information displayed on the advertisements.
- OTHER CONTENT
  - The Website may include hyperlinks to other websites or content or resources. GameOnIndia does not have control over any web sites or resources which are provided by companies or persons other than GameOnIndia.
  - The User acknowledges and agrees that GameOnIndia is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or other materials on or available from such web sites or resources.
  - The User acknowledges and agrees that GameOnIndia is not liable for any loss or damage which may be incurred by the User as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.
- REFUND AND CANCELLATION
  - In relation to provision of Services by GameOnIndia, the User understands and acknowledges that a request from the User for removal of the User from a particular sporting event being organized by GameOnIndia will not be entertained by GameOnIndia after 48 hours from the commencement of such sporting event.
  - The User understands and acknowledges that only such requests for cancellation that are received upto 72 hours prior to the commencement of the sporting event will be accepted by GameOnIndia. However, 25 per cent of the fee paid by the User for that sporting event will be deducted as cancellation fee.
  - In case of cancellation of a sporting event due to GameOnIndia's fault, the complete fee will be refunded to the User. However, in case of postponement of a sporting event, GameOnIndia will compensate the User by offering participation in another sporting event.
  - The User accepts and understands that the content under clause 13 is not absolute and any decisions made under this clause will be at the sole discretion of GameOnIndia.
  - GameOnIndia may provide the User with an option to pay the fees for Services or the sporting events either through an online payment gateway or through its affiliates by physical collecting the fee from the User. The User agrees and confirms that in cases of cancellations or postponements of Services or sporting event(s) (howsoever cause), the User shall not, under any circumstances, approach the payment gateway provided or such GameOnIndia affiliate to seek refund or information related to refunds or information related to the cancellation of postponement of the Services or a sporting event.
- CHANGES TO THE TERMS
  - GameOnIndia may make changes to the Terms at its own discretion without prior notice. When these changes are made, GameOnIndia will make a new copy of the Terms available at [insert URL] and any new terms will be made available to the User.
  - The User understands and agrees that if the User uses the Website to avail Services after the date on which the Terms have been changed; GameOnIndia will treat the use as acceptance of the updated Terms. In situations of any ambiguity or disputes, the decision of GameOnIndia will be final and binding.
